Framework overview

Legislative status

The Brazil AI Act (Marco Legal da Inteligencia Artificial) was approved by the Brazilian Senate in December 2024 as PL 2338/2023. As of early 2025, the bill is still pending presidential sanction/signature and final promulgation.

Supervision

Supervised by ANPD (Autoridade Nacional de Protecao de Dados), the same authority responsible for Brazil's data protection law (LGPD). This leverages existing data protection infrastructure and expertise.

The Brazil AI Act applies to:

Extraterritorial scope: Applies to foreign entities whose AI systems affect persons located in Brazil, regardless of where the entity is established.

Core workflows

Workflow 1 — Risk classification

Inputs: AI system description, sector, use case, affected populations.

Process:

  1. Check excessive risk (prohibited) list — Does the system perform social scoring, subliminal manipulation, exploitation of vulnerabilities, discriminatory profiling, or real-time remote biometric identification in public spaces? If yes → Excessive risk (prohibited). Stop (unless a specific exception applies).
  2. Check high-risk criteria — Does the system operate in a high-risk sector/use case (biometric identification, critical infrastructure, education, employment, essential services, law enforcement, migration, justice, healthcare, autonomous vehicles)? If yes → High-risk.
  3. DefaultNon-high risk (voluntary transparency obligations, encouraged codes of conduct).

Output: Classification result with specific PL 2338/2023 article citations justifying the determination.

Workflow 2 — Rights assessment

Inputs: AI system description, how it interacts with individuals, decisions it makes or supports.

Process: Map all applicable rights of affected persons under the Brazil AI Act:

  1. Identify all touchpoints where the AI system interacts with or affects individuals.
  2. For each right (information, explanation, human review, non-discrimination, correction, data portability, contestation, prior notice), determine applicability.
  3. Assess current implementation status and gaps.
  4. Recommend implementation measures and evidence requirements.

Workflow 3 — Governance system design

Inputs: Organization description, AI systems in scope, existing governance structure.

Process:

  1. Design governance structure — Define roles accountable for AI governance (AI governance officer or committee), establish policies, and set ethical principles.
  2. Plan algorithmic impact assessment process — Determine scope, methodology, responsible parties, and publication requirements for high-risk AI systems.
  3. Establish incident reporting — Define what constitutes a serious incident, reporting timelines (expected: 72 hours), and reporting channels to ANPD.
  4. Set up monitoring — Continuous post-market monitoring for performance, fairness, bias, and model drift.

Output: Structured governance framework document with all required components, responsibilities, and timelines.

Common gaps organizations miss

  1. Excessive risk list not reviewed — Organizations deploying AI in Brazil skip the prohibited practices check, assuming their system is automatically permitted because it is lawful in other jurisdictions. The Brazil-specific prohibited list must be reviewed independently.
  1. Rights of affected persons treated as optional — The Brazil AI Act grants enforceable rights to individuals affected by AI systems, including the right to human review and explanation. These are not best practices but legal obligations aligned with LGPD tradition.
  1. LGPD and AI Act obligations not integrated — Organizations treat LGPD data protection compliance and AI Act compliance as separate workstreams, missing synergies and creating duplicate governance structures. ANPD regulates both.
  1. Algorithmic impact assessment not conducted before deployment — High-risk AI systems require an impact assessment before deployment, not after. Organizations that deploy first and assess later are non-compliant from day one.
  1. Role-specific obligations conflated — Developers, deployers, and operators have distinct obligations. Organizations that hold multiple roles (e.g., developing and deploying their own AI) must satisfy all applicable obligations for each role.
  1. Extraterritorial scope underestimated — Foreign entities whose AI systems affect persons in Brazil are subject to the Act. Organizations operating globally must assess whether their AI systems reach Brazilian residents.
  1. Incident reporting process not established — The Act requires reporting serious AI incidents to ANPD within expected timelines (72 hours for serious incidents). Organizations without a pre-established incident response process cannot meet this requirement.
