Legislation and enforcement

The AI Basic Act (인공지능 기본법, also referred to as the AI Framework Act) was passed by the National Assembly on January 9, 2025 and promulgated on January 22, 2025.

Effective date: January 22, 2026 (one year from promulgation).

Administered by: Ministry of Science and ICT (MSIT).

National AI Committee: Established under the Prime Minister's office to oversee national AI strategy, policy coordination, and ethical principles.

Risk-based approach

The Act adopts a binary risk classification — high-risk versus not high-risk — rather than the multi-tier approach used by the EU AI Act. High-risk AI systems are designated by presidential decree based on sector and use case, and carry enhanced obligations.

Scope and applicability

The AI Basic Act applies to:

  • AI developers — entities that design, develop, or provide AI technology or AI systems
  • AI deployers — entities that deploy or operate AI systems for specific purposes
  • AI users — entities or individuals that use AI system outputs for decisions or actions

Extraterritorial scope: The Act applies to foreign entities providing AI services targeting Korean residents or operating AI systems with effects in South Korea.

Workflow 1 — High-risk AI classification

Inputs: AI system description, sector, intended use case.

Process:

  1. Check presidential decree high-risk categories — Does the system fall under a sector or use case designated as high-risk by presidential decree? Note: specific categories will be defined by decree but are expected to include healthcare, transportation, critical infrastructure, education, employment, financial services, law enforcement, and public safety.
  2. Assess impact on fundamental interests — Does the system significantly affect life, physical safety, or fundamental rights of individuals?
  3. Evaluate classification factors — Consider autonomy level, impact severity, reversibility of outcomes, and whether vulnerable populations are affected.
  4. Consider sector-specific designation — Has MSIT or the National AI Committee issued sector-specific guidance designating the system type?

Output: Classification result (high-risk or not high-risk) with reasoning and article citations.

Workflow 2 — Obligations assessment by role

Inputs: Entity role (developer, deployer, or user), AI system classification (high-risk or not).

Process: Map all applicable obligations to the entity's role:

  1. Identify general obligations that apply to all roles (ethics compliance, transparency).
  2. Identify role-specific obligations (impact assessment for developers, explanation for deployers).
  3. Identify high-risk-specific obligations that apply only if the system is classified as high-risk.
  4. Note obligations where presidential decree will provide additional specificity.

Workflow 3 — Impact assessment

Inputs: High-risk AI system description, deployment context, affected populations.

Process:

  1. Document AI system specifications — Name, version, intended purpose, technical approach.
  2. Identify and assess risks — Potential impacts on life, safety, fundamental rights; who is affected and how.
  3. Document mitigation measures — Controls implemented to reduce identified risks.
  4. Plan human oversight — How humans can monitor, intervene, and override the system.
  5. Establish data governance — Training data quality, bias assessment, data protection measures.
  6. Prepare monitoring plan — Ongoing monitoring approach, metrics, review frequency.
  7. Prepare for MSIT submission — If required, format assessment for regulatory submission.

Workflow 4 — Transparency compliance

Inputs: AI system type, user-facing context, content generation capabilities.

Process:

  1. Assess general AI disclosure obligations — is AI use disclosed to affected persons?
  2. Check deepfake and synthetic content labeling — is AI-generated content labeled?
  3. Evaluate right to explanation compliance — can individuals request and receive explanations of significant automated decisions?
  4. Review system-type-specific notification requirements (chatbots, decision-support, content generation, biometric).

Output: Compliance checklist with status for each transparency requirement.

Common gaps organizations miss

  1. Presidential decree anticipation gap — Organizations wait for presidential decrees to be issued rather than proactively assessing which of their AI systems are likely to be designated high-risk based on the Act's criteria (impact on life, safety, fundamental rights).
  1. Impact assessment timing missed — The Act requires impact assessments before deployment of high-risk AI systems. Organizations that deploy first and assess later will be non-compliant from day one.
  1. Deepfake labeling scope underestimated — The labeling requirement covers all AI-generated synthetic content, not just obvious deepfakes. Organizations using generative AI for content creation may overlook labeling obligations.
  1. Right to explanation infrastructure absent — Deployers must be able to explain significant automated decisions upon request. This requires technical infrastructure (model interpretability, decision logging) that cannot be retrofitted quickly.
  1. Foreign entity obligations overlooked — Non-Korean entities providing AI services targeting Korean residents are subject to the Act. Organizations with Korean user bases must assess their obligations.
  1. Developer vs deployer responsibility confusion — The Act assigns different obligations to developers and deployers. Organizations that both develop and deploy AI systems must satisfy both sets of requirements.
  1. Ethics principles treated as aspirational — The Act's AI ethics principles (human dignity, fairness, transparency, safety, accountability) carry legal weight and inform regulatory enforcement, not merely voluntary guidance.
